The Applicant Bank fired the present oA against Defendant for recovery of a total sum of Rs.21,62,37Ol_ (Rupees Twenty One takhs Sixty Two Thousand Three Hundred and seventy onry) with further interest @ 11.550/o p.a with monthly rests from 2T.IO.2O2S till the date of realization.

2' As per the averments in the apprication, the Appricant Bank states that defendant avaired personar roan under xpress credit scheme with a limit of Rs.22.00 lakhs on 2T.OB.ZOZ3 and agreed to repay in 72 equated monthly installments of Rs,42,49gl_p.m. The defendant executed arrangement retter and personal roan agreement etc in favour of Applicant bank. After availing the loan facilities, the defendants faired to compry the terms of sanction, hence the appricant bank classified the account as NpA on 29.03.2025 and regar notice was issued on 16.09.2025. Inspite of severar reguests and demands, the defendants did not clear the outstanding. Hence this OA.

The point that arise for consideration is whether the Applicant Bank is

entitled forthe claim made in the OA against the Defendant as prayed

for?

Defendant was set exparte. To substantiate the case of the Appricant Bank, AW.1, officiar of the Appricant Bank was examined and he exhibited relevant documents as Ex.A1 to A.9. In view of the above, I hold that the Applicant Bank has established their claim made in the oA against the Defendant and hence the Appricant Bank is entitred to recover the craim made in the oA with future interest and costs.

In the result, the present OA is allowed with costs, as under: The Defendant is liable to pay to the Applicant Bank a total sum of Rs.21,62,37ol- (Rupees Twenty one rakhs sixty Two Thousand Three Hundred and Seventy only) with further interest @ 11.55o/o p.a from 29.t0.2025 till the date of realization.
