Bank of Maharashtra has filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of ₹40,76,982.30p with interest against M/s Jalta Car Care (defendant).

Bank’s case is that on 28.05.2020, it had granted Term Loan of ₹30.00 Lacs, C.C. Limit of ₹3.05 Lacs both facilities under CGTMSE Scheme to defendant i.e. M/s Jalta Car Care, through its proprietor Sunita for business purpose. Again during the COVID-19 pandemic period, applicant bank at the request of the defendants, restructured the

existing loan facilities and granted the following loan facilities to defendant i.e. M/s Jalta Car Care, through its proprietor Sunita for business purpose:

All the loan facilities were chargeable at different rates of interest. To secure all the loan facilities, Defendant i.e. M/s Jalta Car Care through its proprietor Sunita had hypothecated assets (fully detailed in para No.3A of the application). On 18.10.2023, a sum of ₹40,76,982.30p was due from the defendant. Despite repeated requests, defendant did not make the repayment. Hence, this application.

On 30.01.2024, summons was sent to the defendant by registered post, which was duly served. However, defendant did not put in appearance. Vide order dated 21.08.2025, he was proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Sh. Abhishek Bindal, Zonal Manager along with the loan and security documents and marked them as Exhibit A-1 to A-19.

I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced the loans under various schemes and on 18.10.2023, a sum of ₹40,76,982.30p was due.

Accordingly, the application of the bank for the recovery of ₹40,76,982.30p (Rupees Forty Lacs Seventy Six Thousand Nine Hundred Eighty Two and Paise Thirty Only) with interest @10.60% per annum with monthly rests from 04.12.2023, till the date of payment is

hereby allowed with costs. Bank can recover its dues by the sale of the hypothecated assets fully detailed in para No.3A of the application as well as from the personal movable and immovable property(ies) of the defendant.

Pending IAs, if any, stand disposed of. 8. Recovery Certificate be issued accordingly. 9. Party is directed to appear before Recovery Officer on 21.04.2026, who is directed to distribute the sale proceeds of the hypothecated assets as per the provisions of Section 19(20-AB) of the Act . 10. A Copy of this order along with Recovery Certificate be sent to the Recovery Officer as well as the party.
