executed by them. Applicant bank obtained signatures of the defendants on blank, undated and unfilled documents. No mortgage or pledge of assets has been made by the defendants ln favour of the applicant bank. The defendants are engaged in running a restaurant in leased premises. Due to hospitalisation of defendant No.3, the restaurant was closed. The landlord of the premises illegally occupied the leasedpremises including the items lying in thepremises. Applicant bank made efforts to resolve the dispute with the land lords. However, having knowledge of the situation in which defendants areplaced, applicant chose to file thepresent OA. Defendants filed criminal complaint against the land lords vide SR No.1303 of 2025 on the file of the Hon'ble VUI Additional MetropolitanN4agistrate, Ranga Reddy District Courts at Kukatpally. Therefore, applicant bank is not entitled toproceed against the hypothecateditems now lying ln thepossession of the land lords. The statements of account filed by the applicant bank arenot dulycertified as per the Bankers Book of Evidence Act. Hence the claim of applicant bank is liable to be rejected as there is noproof of documents filed by the applicant bank.
