Punjab Gramin Bank has filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the

recovery of ₹36,20,043/- with interest against Sh. Sarwan Kumar and others (defendants).

Bank’s case is that on 27.01.2011, it had K.C.C. Limit of ₹10.00 Lacs and a Term Loan of ₹5.00 Lacs to defendant (since deceased, now represented through his legal heirs) for agricultural purpose. To secure both the loan facilities, Deceased Defendant had mortgaged his agricultural land (fully detailed in para No.3A of the application). The loan was chargeable to interest @10% per annum with yearly rests. Defendants had duly acknowledged their liability towards the debt on 19.02.2009, 24.01.2013, 13.04.2015, 17.06.2017, 03.10.2019 and 26.04.2022. On 16.01.2024, a sum of ₹36,20,043/- was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application.

On 08.04.2024, summonses were sent to the defendants by registered post, which were duly served. However, defendants did not put in appearance. Vide order dated 04.12.2024, they were proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Sh. Iqbal Singh, Manager along with the loan and security documents and marked them as Exhibit A-1 to A-9. 5. I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced the total loan of ₹15.00 Lacs (K.C.C. Limit of ₹10.00 Lacs; Term Loan of ₹5.00 Lacs) and on 16.01.2024, a sum of ₹36,20,043/- was due. 6. Accordingly, the application of the bank for the recovery of ₹36,20,043/- (Rupees Thirty Six Lacs Twenty Thousand Forty Three Only) with interest @10% per annum with yearly rests from 17.01.2024,

till the date of payment is hereby allowed with costs. The liability of all the legal heirs would be limited to the extent of the properties inherited by them from Sh. Sarwan Kumar (now deceased). Bank can recover its dues by the sale of mortgaged land fully detailed in para No.3A of the application as well as from the movable and immovable property(ies) inherited by the legal heirs from Sh. Sarwan Kumar. 7. Pending IAs, if any, stand disposed of. 8. Recovery Certificate be issued accordingly. 9. Parties are directed to appear before Recovery Officer on 28.05.2026, who is directed to distribute the sale proceeds of the mortgaged land and standing crops as per the provisions of Section 19(20-AB) of the Act . 10. A Copy of this order along with Recovery Certificate be sent to the Recovery Officer as well as the parties. Pronounced in the open Court.
