ORDER
This original application has been filed by the applicant bank on 15.01.2024 through Shri Anirudh Bhargav, authorized representative of the applicant bank under Section 19 of Recovery of Debts and Bankruptcy Act, 1993 against the defendants for recovery of a sum of Rs.53,68,929.42 (Rupees Fifty Three Lacs Sixty Eight Thousand Nine Hundred Twenty Nine and paisa Forty Two only) as on 29.05.2023 along with pendentelite and future interest ©18% per annum with

the terms and conditions and failed to regularize the account with applicant Bank. The applicant bank declared the account as NPA on 26.09.2023 due to financial indiscipline and legal notice was issued on 12.12.2023 calling upon the defendants to pay the entire outstanding dues to the applicant bank but the defendants did not clear the dues of the applicant bank. Hence, the applicant bank has approached this Hon'ble Tribunal for recovery of their dues.

FINAL ORDER
I, allow this OA and direct the defendants to pay to the applicant bank within 30 days, jointly or severally, a sum of Rs.53,68,929.42 (Rupees Fifty Three Lacs Sixty Eight Thousand Nine Hundred Twenty Nine and paisa Forty Two only) along with pendentelite and future interest @18% per annum with monthly rests from the date of filing of this application till the date of realization with costs failing which the aforesaid amount shall be recovered from hypothecated stock, book debts, receivables etc. In case of shortfall, the same shall be recovered from sale of the moveable and immovable properties of defendants.
(II) The recovery certificate be issued forthwith and be sent to the Recovery Officer, Debt Recovery Tribunal-I, Delhi.
(III) Parties are directed to appear before the Recovery Officer, DRT I, Delhi on 06.05.2026.
(IV) Copies of final order as well as Recovery Certificate be sent to all concerned free of cost.
