The applicant bank has filed the present Original Application (OA) under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 through the e-DRT portal. As per the directions issued by the Hon’ble DRAT, Delhi, vide Office Order No.01 of 2025 dated 09.09.2025, the applicant bank/financial institution is required to produce the original documents for verification on the date of filing of the OA, and any exception to it can only be made with the approval of the concerned Presiding Officer, but it should not exceed for more than three days from the date of filing.
In the present case, the OA was filed on 26.01.2026. The applicant bank has not produced the original documents for verification. No request for extension of three days’ time, as contemplated in the above Order of the Hon’ble DRAT Delhi, has been made. As such, the OA suffers from defect which remains unrectified within the prescribed time.
The Rule 5(4) of the Debts Recovery Tribunal (Procedure) Rules, 1993 reads as under:
“If the concerned applicant fails to rectify the defect within the time allowed in sub-rule (3), the Registrar may, by order and for reasons to be recorded in writing, decline to register the application.”
Since the applicant bank has failed to rectify the defects within a reasonable period, I find no justification to register this application. Accordingly, the registration of the Original Application is hereby declined.
The applicants, if aggrieved by this order, may prefer a Chamber Appeal before the Hon’ble Presiding Officer under Rule 5(5) of the Debts Recovery Tribunal (Procedure) Rules, 1993 within 15 days from the date of this order.
