The Applicant Bank filed the present OA for the recovery a total sum of Rs. 18,10,62,767.31 ps i.e., Rs. 14,19,39,556.32 ps in respect of the Open Cash Credit with future interest @(15.65% + 2% penal) p.a., Rs. 3,83,97,82t.77 ps in respect of Working Capital Term Loan with future interest @(9.25% + 2o/o genal) p.a. and Rs. 7,28,389.22 ps in respect of Vehicle Loan with future interest @(10.05o/o + 2olo penal) p.a. from the defendant Nos. 1 to 6 jointly and severally with monthly rests from the date of application till the date of realization along with costs. Further, Defendant Nos. 7 to 13 may be directed to remit the

rent amounts, which were earlier being paid to Defendant No. 6, directly to the Applicant Bank.

Summonses were served on Defendant Nos. 2 to 4, and they were set ex parte on 30.07.2025 as they were called absent and no representation. Summons was also served on Defendant No.6, and he was set ex parte on 11.08.2025. Further, summonses were served on Defendant Nos. 1, 5 and 7 to 13, and they were set ex parte on 01.02.2026 for want of appearance and representation.

The Applicant Bank examined Mr. Deelip Thapa, Branch Manager, as AW-1 and marked 34 documents through him as Ex.A.1 to Ex.A.34.

Applicant right to adduce oral arguments was forfeited on 18.05.2026 despite ample opportunities being provided. Perused the material placed on record.

The point that arises for consideration is: -

Whether the Applicant Bank is entitled for the claim made in the OA against the Defendants?

As stated supra, the Defendants remained ex-parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs.A.1 to A.34 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendants. Hence, I hold that the Defendant Nos. 1 k'to 6 are liable to pay
