The Applicant Bank filed the present OA against Defendant for recovery of a total sum of Rs.32,15,704.41. Ps.⁽ Rupees Thirty Two Lakhs Fifteen Thousand Seven Hundred Four and Paise Forty One Only) with future rate of interest @24.00Yo p.a with monthly rests from the date of this application till the date of realization.

As per the averments in the application, the Applicant^Bank states that Defendant availed Personal^{loan facilityof} Rs.30,16,060i- repayable in 60 equated monthly^{installments of} Rs.65,2761 p.m with interest @10.80%^p.a and^executed Agreement of Loan dated 19.06.2025 in^favor of^{the Applicant} Bank. After availing the loan facility, the Defendant^{failed to} comply the terms of sanction, hence the applicant^{bank classified} the account as NPA on 31 .03.2026 and^{issuedDemandNotice} daled 23.04.2026 to the defendant.^lnspite of^{severalrequests} and demands, the defendant did not clear^{the outstanding.Hence} this OA.

The point that arise for consideration is whether the Applicant bank is entitled for the claim made in the OA against the Defendant as prayed for?

Defendant remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and she exhibited relevant documents as Ex.A.1 to A.9. ln view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendants and hence the Applicant Bank is entiiled to recover the claim made in the OA with future interest and costs.

ln the result, the present OA is allowed with costs, as under :

The Defendant is liable to pay to the Applicant Bank a total sum of Rs.32,15,704.41. Ps. ( Rupees Thirty Two Lakhs Fifteen Thousand Seven Hundred Four and paise Forty One Only) with future rate of interest @24.00% p.a from the date of this application till the date of realization.
