The^point that^{arises for consideration is:-}

Whether the^{Applicant Bank is entitled} for the claim^{made in the OA against} the Defendants^{and OA hypothecated} assets?

As stated supra,^{the Defendants remained ex-parteThe} Evidence Affidavit^{coupledwith the recltals in the documents} viz., Exs. A.1 to^{A.13 markedon behalf of the ApplicantBank} clinches the^{claim of the Applicant Bank against the Defendants'} Hence, I hold that^{the Defendants are jointlvanO-r,s,613ttVrliaOte} ' '\6'o\r'^J.'

In the result, the present Original Apptication No.393/2024 is allowed as under: -

i) The Defendants are joinuy and severally liable to pay to the Applicant Bank a total sum of Rs.23,42,916.06ps i.e., the defendants 1 & 2 are joinfly and severally liable to pay a sum of Rs. Rs.18,32,078.70ps towards Composite Term Loan A/c. No. 162030100037348 and the defendants 2 & 3 are^jointly and severally liable to pay a sum of Rs.5,10,837.36ps towards Vehicle Loan

A/c.No.162030100044296l- with future interest @8.80o/o p.a. simple from the date of application till the date of realization;

ii) the OA claim is secured by way of hypothecation of assets described in the schedule annexed to the OA and the applicant bank is entitled to proceed against the same to realise its debt;

iii) the applicant bank is also entifled to proceed against the person and properties of defendants for realization of its dues;

B. The Applicant Bank is directed to file Cost Memo within 2 weeks from the date of receipt of this Order.
