The Applicant Bank filed the present oA against Defendants No.1 to 6 for recovery of a total sum of Rs.28,2514451- (Rupees Twenty Eight Lakhs Twenty Five Thousand Four Hundred Fofi Five

B) a sum of Rs.6,1B,BOU- under loan A/c.No.41955g3g55 with further interest @ 15o/o p.a with monthly rests from date of this application till the date of realization;

As per the averments in the application, the Applicant Bank states that Mr. Sreenivas Bandla availed personal loan under the scheme ..Xpress credit facility term loan" for a sum of rs.1g,50,ooo/- on 13.0L.2023. The borrower executed personal loan agreement and agreed to repay in 72 EMIs of Rs.36,554/- and again availed loan of Rs.5.00 lakhs on 08.06.2023. subsequenfly Mrs. sreenivas Bandla passed away on 29.04.2025 and hence the defendants no.1 to 6 are the legal heirs of the deceased. The deceased Mr. Sreenivas Bandla was employed with defendant no.7 as an sGT, zpHS Mp Banza, Burgampahad, Bhadradri, Kothagudem district. After availing the loan facilities, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NPA on L2.07.2024 and issued legal notice dated L9.L2.202s. Inspite of several requests and demands, the defendants did not clear the outstanding. Hence this oA.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant Bank is entitled for the claim made in the OA against the Defendants as prayed for?

Defendants remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A1 to A.15. In view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendants and hence the Applicant Bank is entitled to recover the claim made in the OA with future interest and costs.

In the result, the present OA is allowed with costs, as under: The Defendants No.1to 6 are jointly and severally liable to pay to the Applicant Bank a total sum of Rs.28,25A451- (Rupees Twenty Eight Lakhs Twenty Five Thousand Four Hundred Forty Five only) i.e.,

a) a sum of Rs.22,06,644/- under loan A/c.No.41588491628 with fu rther interest @ 14.40o/o p.a from date of this application till the da

b) a sum of Rs.6,18,801/- under loan A/c.No.4195593g55 with further interest @ 15o/o p.a from date of this application till the date of realization;

The Defendant no.7 is employer of deceased borrower, is hereby directed to disburse the terminal benefits to the credit of loan account of defendants no.1 to 6 with Applicant bank subject to prevailing rules.

10' The Applicant Bank is also entitled to proceed against the person and properties of defendants no.1 to 6 towards realization of the debt due. However the Applicant bank is entifled to proceed only to the extent of estate devolved upon defendants from the deceased late Mr. Sreenivas Bandla.

The Applicant Bank is entitled to the costs of the OA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.

Issue Recovery certificate accordingly.
