This is an application filed by the applicant U/s 19 of RDB Act, 1993 against defendants for recovery of aggregate amount of Rs. 29,70,882/- with costs and future interest with monthly rests from date of filing Of O.A. till its realization as under : -

A. An amount of Rs. 19,33,552.52 outstanding in Term Loan Account No. 38303924789 with costs and future interest @9% p.a. with monthly rests from the date of filing of O.A. till the date of realization.

B. An amount of Rs. 10,37,329.85 outstanding in Term Loan Account No. 38303938362 with costs and future interest @9.35% p.a. with monthly rests from the date of filing of O.A. till the date of realization.

Though, defendant nos. 1 & 2 were duly served with the suit summons vide Diary No. 3845/2025 and in view of the judgment passed by the Hon’ble Supreme Court in Transfer Petition (Civil) No. 2090/2019 dated 13.10.2023, they failed to cause appearance before this Tribunal to defend their case despite granting several

adjournments. Hence, the proceeding against defendant nos. 1 & 2 was set exparte on 12.08.2025.

The applicant has filed its Claim Affidavit vide Diary No. 5141/2025 alongwith List of Documents, annexing therewith 12 documents. The original documents therein are marked as AW-1/1 to AW-1/12. The applicant has stated in the O.A. as well as in claim affidavit that no penal interest has been charged in the Loan Accounts.

Heard Learned counsel for the applicant.

As stated supra, defendants remained exparte. The Evidence Affidavit coupled with the recitals in the documents viz. AW -1/1 to AW1/12 marked on behalf of the applicant, clinches the claim of the applicant against defendants. There is no reason to disbelieve the evidence adduced on behalf of applicant. Hence, defendants are liable to pay, jointly and severally, the claim of the applicant with costs and future interest.

Hence, it is ordered as under:-

A] O.A. No. 38/2025 is allowed to the extent as under with costs.

B] Defendants to pay jointly and severally to the applicant bank an amount of Rs.19,33,552.52 (Rupees Nineteen Lakh Thirty Three Thousand Five Hundred Fifty Two & Paise Fifty Two Only) outstanding in Term Loan Account No. 38303924789 with simple future interest @9% p.a. from the date of filing of O.A. till its realization.

C] Defendants to pay jointly and severally to the applicant bank an amount of Rs. 10,37,329.85 (Rupees Ten Lakh Thirty Seven Thousand Three Hundred Twenty Nine & Paise Eighty Five Only) outstanding in Term Loan Account No. 38303938362 with simple future interest @9% p.a. from the date of filing of O.A. till its realization.

D] It is declared that outstanding dues are secured by mortgaged immovable properties of defendant no. 1 as described in Schedule of Property in O.A and as referred in AW-1/3 & AW-1/8.

E] Issue Recovery Certificate accordingly.

F] The Registrar is directed to send the copy of Judgment and Recovery Certificate to the parties to this O.A at once.
