No.726 of 2026 supported by affidavit for withdrawal of the O.A. No.38 of 2023. Ld. Advocate for the Applicant submits that the matter has been fully and finally settled with the Defendants for a sum of Rs.9,50,000/- and Defendants have paid the entire amount. Now, the Applicant does not wish to proceed with this O.A. Hence, seeks for withdrawal of the present O.A. In view of the above submissions, the withdrawal of I.A. No.726 of 2026 is allowed. Resultantly, O.A. No.38 of 2023 stands disposed of as withdrawn. Pending IAs, if any, stands disposed of. The Applicant shall be entitled to refund of court fees as per Rules.
