The Applicant Bank filed the^{present OA against Defendant} for recovery of a total sum of Rs.31,04,067.00.^{Ps. (Rupees} Thirty One Lakhs Four Thousand^{and Sixty SevenOnly)} with future rate of interest @24.00Yo^{p.a with monthly rests} from 07.05.2026 till the date of^realization.

As per the averments in the application,^{the Applicant Bank} states that Defendant availed^{Loanfacility of Rs.34,00,000/-} repayable in 72 monthly installments^{of Rs.63,9971with interest} @105%^{p.a and executed necessary loan documents such as} Key fact Statement dated 27.07.2023^{in favor of the Applicant} loan facility, the defendant^{failed to} hence the appllcant bank

dated 25.03.2025 to the defendant. lnspite of several requests and demands, the defendant did not clear the outstanding. Hence this OA.

Defendant called absent and set exparte on 28.07.2026.

Sri. Kalva Rajayaswanth, Area Relationship Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.3.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant bank is entitled for the claim made in the OA against the Defendant as prayed for?

Defendant remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A.1 to A.3. ln view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendant and hence the Applicant Bank is entitled to recover the claim made in the oA with f$lerlll"pjt and costs.

8' rn the result, the present oA is ailowed with costs, as under:

The Defendant is liable to pay to the Applicant Bank a total sum of Rs.31,04,067.00. ps. (Rupees Thirty one Lakhs Four Thousand and Sixty Seven Only) with future rate of interest @24.00o/o^p.a from 07.05.2026 ti[ the dateof realization.

9' The Appricant Bank is entired to proceed against the person and properties of Defendant towards rearization of the debt due.

That Applicant Bank is entifled to the costs of the OA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.

lssue Recovery Certificate accordingly.

Communicate a copy of the order to the parties concerned.
