Canara Bank has filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of ₹48,51,504.94p with interest against Sh. Surjeet Singh @Surjit Singh (defendant). 2. Bank’s case is that on 31.12.2015, it had granted K.C.C. Limit of ₹18.00Lacs to the defendant for agricultural purpose. Again on 04.10.2016, at the request of the defendant, bank enhanced the existing limit from ₹18.00Lacs to ₹27.00Lacs and also granted Overdraft Limit of ₹7.00Lacs for agricultural purpose. The aforementioned limits were renewed on 05.07.2019, K.C.C. Limit for ₹27.00Lacs and Overdraft Limit at ₹7.00Lacs. To secure all the loan facilities, Defendant had mortgaged his land (fully detailed in para No.3A of the application). Both the loan facilities were chargeable at different rates of interest.

Defendant had duly acknowledged his liability towards the debt on 01.04.2019, 01.07.2019, 23.12.2021, 31.03.2022, 21.02.2024 and 29.02.2024. On 30.01.2025, a sum of ₹48,51,504.94p was due from the defendant. Despite repeated requests, defendant did not make the repayment. Hence, this application.

On 28.02.2025, summons was sent to the defendant by registered post, which was duly served. However, defendant did not put in appearance. Vide order dated 13.08.2025, he was proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Sh. Balwinder Kumar, Senior Manager along with the loan and security documents and marked them as Exhibit A-1 to A-23. 5. I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced total loan of ₹34.00 Lacs (₹27.00 Lacs in K.C.C. Limit and ₹7.00 Lacs in Overdraft Limit) and on 30.01.2025, a sum of ₹48,51,504.94p was due.

Accordingly, the application of the bank for the recovery of ₹48,51,504.94p (Rupees Forty Eight Lacs Fifty One Thousand Five Hundred Four and Paise Ninety Four Only) with interest @13.50% p.a. with half-yearly rests from 04.02.2025, till the date of payment is hereby allowed with costs. Bank can recover its dues by the sale of mortgaged land fully detailed in para No.3A of the application as well as from the personal movable and immovable property(ies) of the defendant.

Pending IAs, if any, stand disposed of. 8. Recovery Certificate be issued accordingly.

Party is directed to appear before Recovery Officer on 04.05.2026, who is directed to distribute the sale proceeds of the
