marked with Letter'r' and Exhibit AW-9. copy of sare Deed being No.020600962 for the year 2020 is annexed and marked with Letter ,J, and Exhibit AW_10. The appricant bank has prepared a valuation report of the said property; copy of valuation report dated 18.12.2023 is annexed and marked with Lefter ,K, and Exhibit AW_1 1 . 3. The Defendants avaired and enjoyed the said roan facirities by opening Accounts in Bank's RACPC Durgapur, Durgapur steer rownship, Durgapur, accounts maintained in sARB Burdwan. However, the defendants faired and negrected to abide by the terms and conditions of the facirities. The Defendants did not repay the outstanding Bank,s dues, agreed EMIs and overdue interests in roan Accounts. rnspite of repeated requests and personar contact made by appricant Bank, the defendants faired to regurarize the roan Accounts. since the defendants did not pay any attention to regurarize the Accounts, the Accounts became out of order and was crassified as N.p.A. on 02.04.2023. Thereafter, the applicant Bank issued legal notice dated 10.11.2023 through its Advocate demanding to repay the outstanding Bank's dues, but the defendants did not comply with the said notice; copy of said notice dated 10.'l 1.2023 along with postal receipts and track report are annexed and marked with letter 'M' and Exhibit AW-13. certified copies of Statement of Accounts along with certificate under Bankers, Books of Evidence Act, with statement of claim, have been filed to show and prove the dues (Letter,L, and Exhibit AW-12), and future interest @ 18o/o per annum trom 03.11.2023 tiil the date of rearization, has been prayed. Applicant Bank submitted that their claim in the Application is within limitation. 4. The notices / summons was sent to the Defendants No.1 & 2 by the Tribunar. lt is observed from the S/R on affidavit dated 24.12.2024 and its enclosures that service of Notices / summons upon the Defendants by postar service is successful, such has been recorded vide Ld. Assft. Registrar's order dared 24.12.2024. Despite service, the defendants did not appear nor filed the written statement; thus, both the defendants were ordered to be proceeded ex-pade vide order dated 07.04.2025. Ld. Advocate of the applicant Bank has submitted argument on 07.04.202i. 5. Applicant Bank has filed the evidence-on-affidavit affirmed by Abhijit Chakravorty, chief Manager of Bank's sARB Burdwan, Ulhas Gate No.1, p.o.- Jotram, Dist.- purba Burdwan along with the copies of original documents executed by the Defendants. Original documents have been produced by applicant Bank; the same have been verified with copies of the documents annexed with O.A. and after verification the original documents have been returned to sri Ashoke Mukherjee, Manager of Bank's sARB Burdwan, Ulhas Gate No.1, Dist.- Purba Burdwan, Pin - 713104 on 10.07.2024, such has been recorded in Ld. Registrar's order dated 10.07.2024. The documents produced by applicant Bank are exhibited and annexed at Exhibit AW-1 to AW-13.
