The Applicant Bank filed the present OA for the recovery a total sum of Rs.35,22,525/- as on 06.01.2026 from defendants 1to 4 jointly and severally with future interest @ 12.75o/o p.a. with monthly rests from the date of application till the date of realization along with costs, and in default, sale of OA hypothecated vehicle.

Summonses served on Defendants 3 & 4 and were set exparte on 10.06.2026 as called absent and no representation.

Though 1't and 2nd defendants entered appearance through learned counsel Mr. K. Sai Sri Harsha but did not choose to file written statement. Accordingly, defendants' right of filing written statement was forfeited on 25,06.2026 and was set exparte on the same date. ffix

The Applicant Bank examined Mr. M. Krishna Reddy, Chief Manager, as AW-1 and marked 31 documents through them as Ex.A.1to Ex.A.31.

Heard Learned Counsel for the Applicant. Perused the written arguments filed by the applicant and also perused the material placed on record.

The^point that arises for consideration is:^-

Whether the Applicant Bank is entitled for the claim made in the OA against the Defendants and OA hypothecated vehicle?

As stated supra, the Defendants remained ex-parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs.A.1 to A.31 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendants. Hence, I hold that the Defendants are liable to^pay the OA claim to the Applicant Bank with future interest and costs.

B. In the result, the^present Original Application^{No.32312026is} allowed as under:^-

i) The Defendants 1 to 4 are^jointly and severally liable to^pay to the Applicant Bank a sum Rs. 35,22,5251- with future interest @ 12.75o/o p.a. simple from the date. of application till the date of realization^{'A^-} - U/6^

ii) the OA claim is secured by way of hypothecation of vehicle as described in the schedule annexed to the OA and the applicant bank is entitled to proceed against the same to realise its debt;

iii) the applicant bank is also entifled to proceed against the person and properties of defendants for realization of its dues;

iv) the applicant bank is entiiled for the costs.

The Applicant Bank is directed to file Cost Memo within 2 weeks

from the date of receipt of this Order.

Issue Recovery Certificate accordingly.
