The Applicant Bank filed the^present OA for the recovery a total sum of Rs.25,94,454/- 1.e., a sum of Rs.17,12,002/- towards Vehicle Loan A/c. No.867360510000127 with future interest @10.45olo^p.a., a sum of^{Rs.4,47,355/- towardsPersonalLoan} A/c. No.867360210000109 and a sum of Rs.4,41,097/- towards ''in

Personal Loan A/c. No.867360210000110 with future^interest @L2o/o^p.a. from the^{defendantsjointly and severally plus 2olo} p.a. with monthly rests from the date of application till the date of realization along with costs and in default for sale^of hypothecated vehicle.

Summons served on D1 and 2 through^{paper publication.They} were set ex-parte on 16.10.2025 as called absent and no representation.

The Applicant Bank examined K. Jaganathan, Legal Manager, as AW-1 and marked 46 documents through him as Ex. A.1 to Ex. A.46.

Heard the Ld. Counsel for the Applicant Bank. Perused the material^placed on record.

The point that arises for consideration is:-

Whether the Applicant Bank is entitled for the claim made in the OA against the Defendants and OA hypothecated vehicle?

As stated supra, the Defendants remained ex-parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs. A.1 to A.46 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendants. Hence, I hold that the Defendants are^jointly and severally liable to pay the OA claim to the Appliqqnt Bank with future interest and costs. /AY<,* 0/'6q'"

In the result, the present Original Application No,320/2025 is allowed as under: -

i) The Defendants are jointly and severally liable to pay to the Applicant Bank a total sum of Rs.25,94,4541- i.e., the defendants 1 and 2 are jointly and severally liable to pay a sum of Rs.17,12,002/- towards Vehicle Loan A/c.No.867360510000127, the 1st defendant is liable to pay a sum of Rs.4,41,355/towards Personal Loan A/c. No. 867360210000109 and the 2nd defendant is liable to pay a sum of Rs.4,41,097/- towards Personal Loan A/c.No.867360210000110; wtth'futurE lnterest'@7'.957o*p:a :Slrnple ftoffi the date of application till the date of realization;

ii) the OA claim is secured by way of hypothecation of vehicle described in the schedule annexed to the OA and the applicant bank is entitled to^proceed against the same to realise its debt;
