Jammu and Kashmir Bank Limited has filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of ₹27,93,110.12p with interest against Mr. Showkat Ali @ Shokat Ali and others (defendants).

Bank’s case is that on 14.09.2023, it had granted a loan of ₹26,27,152/- to defendant No.1 in the form of Term Loan for vehicle purpose. To secure the loan, Defendant No.1 had hypothecated his vehicle bearing registration No. JK-08-N-5509 (fully detailed in para

No.3A of the application). Defendant Nos.2 and 3 stood as guarantors vide Deed of Guarantee dated 16.09.2023. The loan was chargeable to interest @7.70% per annum with monthly rests. On 30.11.2025, a sum of ₹27,93,110.12p was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application.

On 27.01.2026, summonses were sent to the defendants by registered post, which were duly served. However, defendants did not put in appearance. Vide order dated 06.07.2026, they were proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Sh. Ashish Bhasin, Manager along with the loan and security documents and marked them as Exhibit A-1 to A-15.

I have perused the evidence on the record. Sh. Rakesh Singh, Senior Manager is present with the original documents which have been perused by me. The same have been returned to him after perusal. I am of the considered view that the Bank has proved its case that it had advanced the loan of ₹26,27,152/- and on 30.11.2025, a sum of ₹27,93,110.12p was due.

Accordingly, the application of the bank for the recovery of ₹27,93,110.12p (Rupees Twenty Seven Lacs Ninety Three Thousand One Hundred Ten and Paise Twelve Only) with interest @7.70% per annum with monthly rests from 25.03.2026, till the date of payment is hereby allowed with costs. The liability of all the defendants would be joint and several. Bank can recover its dues by the sale of hypothecated vehicle fully detailed in para No.3A of the application as well as from the personal movable and immovable property(ies) of the defendants.
