ORDER

The Applicant Bank filed the present OA against Defendant for recovery of a total sum of Rs.22,72,726.37. Ps. (Rupees Twenty Two Lakhs Seventy Two Thousand Seven Hundred Twenty Six and Thirty Seven Paise Only) with future rate of interest @24.00% p.a with monthly rests from the date of this application till the date of realization.

As per the averments in the application, the Applicant Bank states that Defendant availed Personal Loan facility of Rs.18,37,000/- repayable in 94 equated monthly installments of Rs.49,9021 p.m with interest @11.25Yo p.a with monthly rests and executed necessary loan documents such as Loan Agreement dated 31 .01.2019 in favor of the Applicant Bank. After availing the loan facility, the defendant failed to comply the terms of sanction, hence the applicant bank classified the account as NPA and issued Demand Notice dated 26.022026 to the defendant. lnspite of several requests and demands, the defendant did not clear the outstanding. Hence this OA.

Mr. K. Pranay Kumar, Legal Manager of the Applicant^Bank examined himself as AW.1 and exhibited^{relevantdocuments,} which are marked as Ex.A.1 to A.9.

Heard the Ld. Counsel for the Applicant^Bank.

The point that arise for consideration is whether^{the Applicant} bank is entitled for the claim made in the OA against^the Defendant as^prayed for?

Defendant remained exparte. To^substantiate the^{case of the} Applicant Bank, AW.1, official of the^{Applicant Bank was} examined and he exhibited relevant^documents as^Ex.A.1to A.9. ln view of the above, I hold that^{the Applicant Bankhas} established their claim made^{in the OA against the Defendantand} hence the Applicant Bank is entitled to^{recover the claim made in} the OA with future interest^{and costs.}

The Applicant Bank is entifled to proceed against the person and properties of Defendant towards rearization of the debt due.

Communicate a copy of the order to the parties concerned.
