The Applicant Bank filed the present OA against Defendants for recovery of a total sum of Rs.74,16,575.00 Ps. (Rupees Seventy Four Lakhs Sixteen Thousand Five Hundred and Seventy Five Only) i.e a sum of - (i) Rs.10,97,568.00 Ps. + (ii) Rs.53,19,007.00 Ps. together with future rate of interest @13.15o/o^{p.awithmonthlyrestsfrom 31.03.2026till the date} of realization and in default for sale of Hypothecated Movables as mentioned in the Schedule of Property to OA.

As per the averments in the application, the Applicant Bank states that Defendant no. 1 is a private limited company its Directors Defendants No. 2 to 4 availed cash s.10.00 Lakhs with interest @13.40% p.a 70.00 Lakhs repayable in 69 equated Rs 1,01,4504 p.m with interest

@13.40%^{p.a and executed necessary} loan documents such as Agreement of Loan cum Hypothecation dated 07.11.2023 in favor of the Applicant Bank. The Defendants hypothecated movables morefully mentioned in Schedule of property to OA and executed Agreement of Loan cum Hypothecation dated 07.11.2023 in favor of the Applicant Bank. The Defendants stood as a Guarantor and executed Guarantee Agreement dated 07.11.2023 in favor of the Applicant bank. After avaiting the loan facility, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NPA on 01.05.2025 and issued Legat Notice dated 09.03.2026 to the defendants. lnspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.

Defendants called absent and set exparte on 03.07.2026.

Sri. Ajit Singh Yadav, Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.10.

Defendants remained exparte. To substantiate the case of the Applicant Bank, AW.1 , official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A.1 to A.10. ln view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendants and hence the Applicant Bank is entitled to recover the claim made in the OA with future interest and costs.

ln the result, the present OA is allowed with costs, as under :

The Defendants no. 1 to 4 are jointly and severally liable to pay to the Applicant Bank a total sum of Rs.74,16,575.00 ps. (Rupees Seventy Four Lakhs Sixteen Thousand Five Hundred and Seventy Five Only) i.e a sum of - (i) Rs.10,97,s69.00^ps. + (ii) Rs.63,19,007.00 ps. together with future rate of interest @13.15%p.a from 31.03.2026 till the date of realization.

The Applicant Bank is entitled to proceed against the Hypothecated Movables as mentioned in the Schedule of Property to the OA towards realization of the debt due.

Bank is entitled to proceed against the person of Defendants no. 2 to 4 and properties of DefU'ilant N pany towards realization of the debt due. 7 JUr.20?6

That Applicant Bank is entitled to the costs of the OA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.
