This original application has been filed by the applicant bank on 29.04.2024 through Mr. Shashank Daksha, authorized representative of the applicant bank under Section 19 of Recovery of Debts Due to Banks and Financial Institutions Act, 1993 against the defendant for recovery of Rs.30,87,046/(Rupees Thirty Lacs Eighty Seven Thousand Forty Six only) as on 31.03.2024 along with pendentelite and future interest at contractual interest per annum with monthly rest from the date of filing of this application till the date of realization and costs.

The brief facts of the case are that at the request of defendant, the applicant bank sanctioned and disbursed vehicle loan facility for Rs.49.00 Lacs (Rupees Forty Nine Lacs only) on 18.11.2021 under Union Miles scheme of the bank @7.30% interest per annum, which was to be repayable in 84 Equated Monthly Installments of Rs.74,674/- in order to purchase new car Mercedes Benz GLC 220 d FL MY 2021 model against hypothecation of vehicle.

That in order to avail the vehicle loan facility, the defendant submitted Loan Application and executed Demand Promissory Note, Letter of Continuity (AD-09 M), Letter of Lien AD-02A, Hypothecation of Vehicles Agreement (SD-10), Letter of Undertaking, Interest Agreement (SD-24), Performa Invoice, Loan application on 18.11.2021 in favour of applicant bank.

That in order to avail the loan facility, defendant mortgaged Mercedes Benz GLC 220 d FL MY 2021 car model bearing Registration no.CH-01CH3639 with the applicant bank.

The defendant executed Debit Balance Certificate on 18.11.2022 acknowledging liability towards the applicant bank.

It has been submitted by the applicant bank that after availing the vehicle loan facility, the defendant failed to comply with the sanction terms and conditions despite several requests and reminders. The applicant bank classified the account as Non-Performing Asset on 24.02.2024 and issued recall notice dated 26.02.2024 and served legal notice dated 08.04.2024 but defendant failed to clear the dues. Hence, the applicant bank has approached this Tribunal for recovery of their dues.

Notices of this O.A. were issued to the defendant and despite proper service, the defendant has chosen to absent from the proceedings. As per order dated 03.11.2025, the defendant has been proceeded ex-parte due to nonappearance, non-filing of written statement, evidence and affidavit of assets before this Tribunal.

In order to prove its case, the applicant bank has filed its evidence by way of affidavit of Shri Shashank Daksha, authorized representative of the applicant bank who has proved the documents such as Power of Attorney, Sanction Advice, Demand Promissory Note, Letter of Continuity, Letter of Lien, Hypothecation of Vehicles Agreement, Letter of Undertaking from Borrower, Interest Agreement, Performa Invoice, Loan Application, Debit Confirmation Certificate, Recall Notice, NPA Certificate, Legal Notice, Statement of Account marked as Ex.AW-1/1 to Ex.AW-1/9.

The applicant bank has fully corroborated the averments made in the O.A. Even otherwise the whole case of the applicant bank is based on the documents and the same have been duly proved.

The case filed by the applicant bank gone unrebutted and there is no question of disbelieving the case of the applicant bank and applicant bank has proved its case beyond reasonable doubts.

In the light of the above discussions and documents on record, the Original Application deserves to be allowed.

allow this OA and direct the defendant to pay to the applicant bank within 30 days, a sum of Rs.30,87,046/(Rupees Thirty Lacs Eighty Seven Thousand Forty Six only) as on 31.03.2024 along with pendentelite and future interest @7.30% per annum with monthly rest from 01.04.2024 till the date of realization alongwith costs, failing which the aforesaid amount shall be recovered from sale of Vehicle namely Mercedes Benz GLC 220 d FL MY 2021 model bearing Registration no.CH-01CH-3639. In case of default, the same shall be recovered from the sale of movable and immovable assets of the defendant.

(II) The recovery certificate be issued forthwith and be sent to the Recovery Officer, Debt Recovery Tribunal-I, Delhi.

(III) Parties are directed to appear before the Recovery Officer, DRT I, Delhi on 23.04.2026.

(IV) Copies of final order as well as Recovery Certificate be sent to all concerned free of cost.
