As per the averments in the application,^{the ApplicantBank states} that Defendant is a Proprietorship^{Firmrepresented by its Sole} Proprietor Konda Radhika,^{availed Term loan facility of} Rs.40.00 Lakhs repayable in^{120 monthlyinstallmentsof} Rs.60,515/- p.m with^interest @125%^{p.a andexecuted} Agreement of Loan-cum-Hypothecation^{dated 08.05.2026in favor} of the Applicant^{Bank.The Defendant No. 2 stood as a Guarantor} and executed^{Guarantee Agreement dated 08'05.2026in favor of} the Applicant Bank.^{After availing the loan facility,the defendant} failed to comply^{the terms of sanction,hence the applicantbank} classified the^{account as NPA on 09.07.2025and issued} Legal Notice dated^{17-01.2026 to the defendants' lnspite of} several requests^{and demands,the defendantsdid not clear the} outstanding. Hence^{this OA.}

The point that arise for consideration is whether the Applicant bank is entitled for the claim made in the OA against the Defendants as prayed for?

Defendants called absent and set exparte. To substantiate the case of the Applicant Bank, AW.1, official of the^{Applicant Bank} was examined and he exhibited relevant documents as^Ex.A.1to A.9. ln view of the above, I hold that the Applicant^{Bank has} established their claim made in the OA^{against the Defendants} and hence the Applicant Bank is^{entitledto recover the claim} made in the OA with future^{interest and costs.}

ln the result, the^{present OA is allowedwith costs, as under:}
