The Applicant Bank filed the present OA for the recovery a total sum of Rs.21,01,32,314.33ps as on 31.01.2025 from the defendants jointly and severally with future interest @1go/o p.a. with monthly rests plus 2o/o penal interest from the date of application till the date gf rearization arong with costs and in default for sale of OA schedule properties.

Summon served on Defendants 1 & 3 through paper publication and summon served on defendants 2 & 5 through registered post and were set ex-parte on 12.08.2025 as called absent and no representation. Defendant No.4 failing to file vakalat was also set ex-parte on 01.09.2025 as called absent and no representation.

The Applicant Bank examined Mr. Srikanth Sukhavasi, Asst. Vice President, as AW-1 and marked 29 documents through him as Ex.A.1 to Ex.A.29.

, 4. Heard the Ld. Counsel for the Applicant Bank. Perused the material placed on record.

The point that arises for consideration is:^-

Whether the Applicant Bank is entitled for the claim made in the OA against the Defendants and OA Schedule properties?

As stated supra, the Defendants^{remained ex-parte. The} Evidence Affidavit coupled with the recitals^{in the documents} viz., Exs.A.1 to A.29 marked on behalf of^{the ApplicantBank} clinches the claim of the Applicant^{Bank against the Defendants.} Hence, I hold that the Defendants are^liable to^{pay the OA claim} to the Applicant Bank with^{futureinterest and costs.}

In the result, the^present Original^{ApplicationNo.23512025is} allowed as under:^-

i) The Defendants are^jointly and^severally liable to^pay to the^{Applicant Bank a sum of} Rs.21,01,32,314.33ps with^{future interest} @9.5olo^{p.a. simple from the dateof} application till the date^{of realization;}

ii) the OA claim is secured^{by way of mortgage} of properties described^{in the schedule} annexed to the OA^{and the applicantbank is} entitled to^proceed against^{the same to} rearise its debt; 4W*
