The Ld. counsel for the applicant bank submits that the Applicant Bank has already instituted recovery proceedings against the same Defendants before the Honble Debt Recovery Tribunal- I, Delhi, which is registered as Transfer Application (TA) No. 8212024, arising out of the very same loan transaction and founded upon an identical cause of action. The said proceedings before the Hon'ble DRT-I, Delhi are presently sub judice and are listed for hearing on L4.07.2026. The institution of the present original Application before this Hon'ble Tribunal has occurred on account of an inadvertent administrative . and procedural oversight, leading to parallel proceedings being initiated in respect of the same subject matter before two different Hon'ble Tribunals. In view of the pendenry of the earlier and prior proceedings before the Honble DRT-I, Delhi, the Applicant Bank, in the interest of justice, judicial propriety, and to avoid any procedural incongruity, does not wish to pursue the present original Application any further. The present application is being made bona fide, in good faith, and in the larger interest of justice, and no prejudice whatsoever shall be caused to the Defendants, as the substantive dispute between the parties continues to remain under adjudication before a competent forum. Therefore, it is prayed that permit the applicant bank to withdraw the present original Application bearing No. 231/2ozs, in tight of the pendency of Transfer Application No. B2l2024 before the Honble DRT-I, Delhi.
