The Applicant Bank filed the present OA against Defendant for recovery of a total sum of Rs.36,24,455.00 Ps. ( Rupees Thirty Six Lakhs Twenty Four Thousand Four Hundred and Fifty Six Only) with future rate of interest @11.15% p.a with monthly rests plus penal interesl @4o/o p.a from the date of this application till the date of realization.

As per the averments in the application, the Applicant Bank states that Mr.Chapa Buchaiah availed Personal loan under Xpress Credit Elite Scheme of Rs.35,00,0001 repayable in 72 equated monthly installments of Rs.66,8891 p.m with interest @11J5%^{p.a with monthly rests and executed PersonalLoan} Agreement dated 28.12.2023 in favorof the Applicant Bank. After availing the loan facility, Mr. Chapa Buchaiah failed to comply the terms of sanction, hence the applicant bank classified the account as NPA on 28.03.2025. Mr. Chapa Buchaiah died on 20.11.2024 and the Defendant is the legal heir of Late Mr. Chapa Buchaiah. The Applicant Bank issued Legal Notice dated 19.05.2025 to ant. lnspite of several requests and not clear the outstanding. Hence this

Sri. Madas Bharath Chandra filed Vakalat on behalf of Defendant. No representation from Defendant side and WS of Defendant No. not filed and hence Defendant called absent and set exparte on 18.08.2026.

Sri. K. Jagadish, Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.10.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant bank is entitled for the claim made in the OA against the Defendant as prayed for?

Defendant remained exparte. To substantiate the case of the
Applicant Bank, AW.1 , offlcial of the Applicant Bank was
examined and he exhibited relevant documents as Ex.A.1 to
A.10. ln view of the above, I hold that the Applicant Bank has
established their claim made in the OA against the Defendant and

ln the result, the present OA is allowed with costs, as under :

The Defendant is liable to pay to the Applicant Bank a total sum of Rs.35,24,456.00 Ps. ( Rupees Thirty Six Lakhs Twenty Four Thousand Four Hundred and Fifty Six Only) with future rate of interest @11.15% p.a from the date of this application till the date of realization.

The Applicant Bank is entitled to proceed against the person and properties of Defendant towards realization of the debt due. The Applicant Bank is entitled to proceed only to the extent of estate devolved upon the Defendant from the deceased Husband Late Mr. Chapa Buchaiah.

That Applicant Bank is entitled to the costs of the OA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.
