Atul Gupta, Branch Manager of the applicant, who is competent to institute the Original Application vide Power of Attorney dated 08.02.2018, which is Annexure A1(B) to this OA. 2. The brief facts of the OA are that defendant no. 1 through its Proprietor defendant no. 2 approached the applicant for grant of CC Limit of Rs. 10.00 Lacs vide Loan Application dated 10.03.2014, which is Annexure A2 to this OA. Thereafter, defendant no. 2 approached the applicant for grant of DL Syndsaral Non-Salaried MCLR of Rs. 2.00 Lacs vide Loan Application dated 28.07.2016, which is Annexure A8 to this OA. Thereafter, defendant no. 1 through its Proprietor defendant no. 2 approached the applicant for renewal of CC Limit of Rs. 10.00 Lacs. 3. The applicant sanctioned CC Limit of Rs. 10.00 Lacs and the terms and conditions were duly accepted by the defendants. Thereafter, the applicant sanctioned DL Syndsaral Non-Salaried MCLR of Rs. 2.00 Lacs vide Sanction Letter dated 28.07.2016, which is Annexure A9 to this OA. Thereafter, the applicant sanctioned renewal of CC Limit of Rs. 10.00 Lacs vide Letter dated 19.07.2017, which is Annexure A13 to this OA. Defendant no. 3 stood as guarantor in both the loan accounts. 4. Defendant no. 2 mortgaged his immovable property i.e. Plot measuring 00K 01M situated at Area Rupnagar, Hadbast no. 44, Tehsil and District Roopnagar, Punjab vide Sale Deed bearing vasika no. 2677 dated 16.01.2014 along with its translation, Letter handing over Title Deeds of Property and Confirmation of Deposit of Title Deeds, both dated 10.03.2014 and Confirmation of creation of subsequent Equitable Mortgage dated 28.07.2016, which are Annexure A5 to A7 and A12 to this OA.
