The Applicant Bank filed the present OA for the recovery a total sum of Rs.65,61,796.2ps i.e., a sum of Rs.39,04,789.66ps towards Term Loan A/c. No.7367001600008301 with interest @9.70o/o^p.a., a sum of Rs.19,85,872.54ps towards Cash Credit Loan A/c. No.7367000600001601 with interest @14.50o/o p.a., a sum of Rs.5,67,624/- towards Term Loan A/c. No.7367001600024601 with interest @9.24o/o p.a. and a sum of Rs.1,03,510/- towards GECL Term Loan A/c. No.7367001800011801 with interest @8.96% p.a. from the defendants jointly and severally from the date of application till the date of realization along with costs and in default for sale of OA schedule properties.

Summons served on D4 and 5 through paper publication and were set ex-parte on L2.08.2025 as called absent and no representation. WS of D1 to 3 not filed hence, their right of filing was forfeited on 06.01.2026. DE not filed by D1 to 3 hence, their right was forfeited and were set ex-parte on 74.07.2026 as called absent and no representation.

Heard the Ld. Counsel for the Applicant Bank. Perused the material placed on record.

The point that arises for consideration is:-

Whether the Applicant Bank is entitled for the claim made in the OA against the Defendants and OA schedule properties?

As stated supra, the Defendants remained ex-parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs. A.1 to A.54 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendants. Hence, I hold that the Defendants are^jointly and severally liable to pay the OA claim to the Appllcant Bank with future interest and costs.

In the result, the present Original Application No.208/2025 is allowed as under: -

i) The Defendants are^jointly and severally liable to pay to the Applicant Bank a total sum of Rs.65,67,796.2ps i.e., a sum of Rs.39,04,789.66ps towards Term Loan A/c. No.7367001600008301, a sum of Rs.19,85,872.54ps towards Cash Credit Loan A/c. No.7367000600001601, a sum of Rs.s,67,624/- towards Term Loan A/c. ii) the OA claim is secured by way of mortgage of properties described in the schedule annexed to the OA and the applicant bank is entitled to proceed against the same to realise its debt;

iii) the applicant bank is also entitled to proceed against the person and properties of defendants for realization of its dues;

iv) the applicant bank is entitled for the costs.

B. The Applicant Bank is directed to file Cost Memo within 2 weeks from the date of receipt of this Order.

Issue Recovery Certificate accordingly.
