On 04.12.2024, Punjab National Bank filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of Rs.25,53,036.79p with interest against Sh. Bikkar Singh (defendant). 2. Bank’s case is that on 11.10.2012, it had granted a KCC limit of Rs.20.00Lacs to the deceased defendant for agricultural purpose. To secure the limit, deceased defendant had hypothecated stocks and mortgaged land (fully detailed in para Nos.5.5 and 5.6 of the application, respectively). The loan was chargeable to interest @11.50% per annum with half-yearly rests. The defendants and the Legal Heirs had

acknowledged their liability towards the debt on 03.10.2015, 21.08.2018, 26.05.2021 and 22.01.2024. On 03.11.2024, a sum of Rs.25,53,036.79p was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application.

On 31.12.2024, summonses were sent to the defendants by registered post, which were duly served. However, defendants did not put in appearance. Vide order dated 28.05.2025, they were proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Sh. Sandeep Kumar, Chief Manager, along with the loan and security documents.

I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced a KCC limit of Rs.20.00Lacs and on 03.11.2024, a sum of Rs.25,53,036.79p was due. 6. Accordingly, the application of the Bank for the recovery of Rs.25,53,036.79p (Rupees Twenty-Five Lacs Fifty-Three Thousand Thirty-Six and Paise Seventy-Nine Only) with interest @9.90% per annum with half-yearly rests from 04.12.2024, till the date of payment is hereby allowed with costs. The liability of both the legal heirs would be limited up to the extent of properties inherited by them from the estate of the deceased borrower for the whole of the decretal amount. Bank can recover its dues by the sale of hypothecated stocks and mortgaged land (fully detailed in para Nos.5.5 and 5.6 of the application, respectively) as well as from the personal movable and immovable property(ies) of the defendants.
