On 20.11.2023 SBI filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of Rs.33,30,722/- with interest against Sh. Bilal Ahmad Malik (defendant).

Bank’s case is that on 10.04.2019, it had granted a Vehicle Loan Facility of Rs.24.80 lacs to the defendant for business purpose. To secure the loan, defendant had hypothecated his vehicle (fully detailed in para No.5.7 of the application). The vehicle loan was chargeable to interest @12.35% per annum with monthly rests. On 14.07.2020, Bank had granted a WCTL, under GECL Scheme, of Rs.4.83 lacs to the defendant for vehicle purpose. On 24.01.2022, Bank had granted another WCTL, under GECL Scheme, of Rs.2,81,216/- to the defendant for vehicle purpose. Both the WCTLs were chargeable to interest @7.80% per annum with monthly rests. 25.07.2023. On 09.11.2023, a sum of Rs.33,30,722/- was due from the defendant. Despite repeated requests, defendant did not make the repayment. Hence, this application.

On 22.01.2024, summons was sent to the defendant by registered post, which was duly served. However, defendant did not put in appearance. Vide order dated 21.07.2025, he was proceeded ex parte . 4. In order to prove its case, the Bank has placed on record the affidavit of Mohd.Syed Shah, Deputy Manager, along with the loan and security documents. 5. I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced Vehicle Loan Facility of Rs.24.80 lacs, a WCTL-I of Rs.4.83 lacs and another WCTLII of Rs.2,81,216/- and on 09.11.2023, a sum of Rs.33,30,722/- (Term Loan: Rs.27,17,155/-; WCTL-I: Rs.2,89,476/-; WCTL-II: Rs.3,24,091/-) was due.

Accordingly, the application of the Bank for the recovery of Rs.33,30,722/- (Rupees Thirty Three Lacs Thirty Thousand Seven Hundred Twenty Two Only) Rs.27,17,155/- with interest @12.35% per annum with monthly rests in term loan; Rs.2,89,476/- and Rs.3,24,091/in WCTL-I and II both with interest @9.25% per annum with monthly rests from 20.11.2023, till the date of payment is hereby allowed with costs. Bank can recover its dues by the sale of hypothecated vehicle (fully detailed in para No.5.8 of the application) as well as from the personal movable and immovable property(ies) of the defendants. 7. Pending IAs, if any, stand disposed of. 8. Recovery Certificate be issued accordingly.
