On 29.11.2024, Union Bank of India filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of Rs.66,17,407.56p with interest against Sh. Samrat Chibba and others (defendants).

Defendant No.1 is the borrower and defendant Nos.2 and 3 stood as Guarantors. Bank’s case is that on 23.11.2017, it had granted Cash Credit (Agriculture) under Union Green Card Scheme for Farmers of Rs.40 lacs to defendant No.1 for Agricultural purpose. To secure the facility, Defendant No.1 had hypothecated standing Crops and other

Cultivation tools (fully detailed in Annexure A-5 attached with the application) and mortgaged his agricultural land (fully detailed in para No.5.6 of the application). Defendant Nos.2 and 3 stood as Guarantors for the above facility vide Guarantee Deed dated 23.11.2017. The limit was chargeable to interest @11.10% per annum with half-yearly rests. On 25.09.2024, a sum of Rs.66,17,407.56p was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application.

On 16.12.2024, summonses were sent to the defendants by registered post, which were duly served. However, defendants did not put in appearance. Vide order dated 01.09.2025, they were proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Mr. Vinay Chourasiya, Branch Manager, along with the loan and security documents. 5. I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced a Cash Credit facility of Rs.40 lacs and on 25.09.2024, a sum of Rs.66,17,407.56p was due.

Accordingly, the application of the bank for the recovery of Rs.66,17,407.56p (Rupees Sixty-Six Lacs Seventeen Thousand Four Hundred Seven and Paise Fifty-Six Only) with interest @13.10% per annum with yearly rests from 29.11.2024, till the date of payment is hereby allowed with costs. The liability of all the defendants would be joint and several. Bank can recover its dues by the sale of hypothecated standing Crops and other Cultivation tools (fully detailed in Annexure A- 5 attached with the application) and mortgaged agricultural land (fully

detailed in para No.5.6 of the application) as well as from the personal movable and immovable property(ies) of the defendants.

Pending IAs, if any, stand disposed of. 8. Recovery Certificate be issued accordingly. 9. Parties are directed to appear before Recovery Officer on 28.09.2026, who is directed to distribute the sale proceeds of the mortgage land and standing crops as per the provisions of Section 19(20AB) of the Act . 10.
