Summons served on D1 and 2. They were set ex_parte on 27.04.2026 as called absent and no representation.

The Applicant Bank examined Sreekanth Reddy Bathula, Legal Manager, as AW-1 and marked 44 documents through him as Ex. A.1 to Ex. A.44.

Heard the Ld. Counsel for the Applicant Bank. perused the material placed on record.

The point that arises for consideration is:-

Whether the Applicant Bank is enti ed for the claim made in the OA against the Defendants and OA sciedule properties?

As stated supra, the Defendants remained ex_parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs. A.1 to A.44 marked on behalf of the Applicant Bank crinches the craim of the Appricant Bank against the Defendants. Hence, I hold that the Defendants are join y and severally liable to pay the oA craim to the Appricant Bank with future interest and costs.

i) The Defendants are jointly and severally liable to pay to the Applicant Bank a total sum of Rs.74,43,359.60ps i.e., a sum of Rs.1,30,164.18ps towards Loan A/c. No. 33778540002325, a sum of Rs.44,86,942.04ps towards Loan A/c. No, 337779t0000057, a sum of Rs.23,50,387.14ps towards Loan A/c. No. 3377822000O43L and a sum of Rs.4,75,866,24ps towards Loan A/c. No. 33778010021423; with future interest @12.85o/o^p.a. simple from the date^of application till the date of realization;

ii) the OA claim is secured by way of mortgage of properties described in the schedule annexed to the OA and the applicant bank^is entitled to^proceed against the^{same to} realise its debt;
