The brief facts of the OA are that the defendant no.1 through its proprietor defendant no.2, approached the applicant for the grant of Term Loan of Rs.12.75 Lacs for purchase of used commercial vehicle i.e. TATA LPK2518 vide None individual customer relation form dated 05.04.2023, which is Annexure A2 to this OA. Defendant no. 3 stood as guarantor. Thereafter, the defendant no. 1 through its proprietor defendant no.2, approached the applicant for the grant of Term Loan of Rs.87.50 Lacs for purchase of two commercial vehicles i.e. MAHINDRA BALAZO 35 vide None individual customer relation form dated 30.07.2024, which is Annexure A9 to this OA. Defendant no. 4 stood as guarantor. 3. The applicant sanctioned Term Loan of Rs.13,21,684.00 and terms and conditions were duly accepted by defendant nos. 1 to 3. Loan cum guarantee agreement dated 30.04.2023, which is Annexure A3 to this OA. Thereafter, the applicant sanctioned Term Loan of Rs.87.40 Lacs and terms and conditions were duly accepted by defendant nos. 1, 2 and 4.
