The Applicant Bank filed^{the present OA against Defendant for} recovery of a total sum of^{Rs.26,74,963/-( Rupees Twenty Six} lakhs Seventy Four Thousand^{Nine Hundred Sixty Three} Only) with future rate^{of interest} @13.90%^{p.a with monthly} rests from 29.04.2025 till^{the date of realization.}

ln the result, the present OA is allowed with costs, as under :

The Defendant no. 3 is liable to pay to the Applicant Bank a total sum of Rs. 26,74,9631- ( Rupees Twenty Six lakhs Seventy Four Thousand Nine Hundred Sixty Three Only) with future rate of interest @13.90% p.a from 29.04.2025 till the date of realization.

The Applicant Bank is entitled to proceed against the person and properties of Defendant no. 3 towards realization of the debt due. However the applicant bank is entitled to procced only to the extent of estate devolved upon the Defendant No. 3 from deceased Defendant no. 1.

That Applicant Bank is entitled to the costs of the OA.

The Applicant shall file a cost memo within two weeks^{from the} date of receipt of order.
