Punjab Gramin Bank has filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of ₹35,73,747.15p with interest against Sh. Gurdeep Singh @ Gurdip Singh and others (defendants).

Bank’s case is that on 20.01.2015, it had granted PGB Krishi Card Limit of ₹19.00 Lacs and Term Loan of ₹1.00 Lacs both aggregating to ₹20.00 Lacs to the defendant (since deceased, now survived by his legal heirs) for agricultural purpose. To secure the limits, Deceased Defendant had mortgaged his land (fully detailed in para No.3A of the application). The PGB Krishi Card Limit was chargeable to interest @12.50% p.a.

and the Term Loan was chargeable to interest @12% p.a. both with yearly rests. Defendant Nos.1.2 and 1.3 being the Legal heirs of Sh. Gurdeep Singh @ Gurdip Singh (now deceased) had duly acknowledged their liability towards the debt on 05.02.2018 and 24.09.2020. On 31.08.2023, a sum of ₹35,73,747.15p was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application.

On 19.10.2023, summonses were sent to the defendants by registered post, which were duly served. However, defendants did not put in appearance. Vide order dated 12.11.2025, they were proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Sh. Gurdeep Singh, Branch Manager along with the loan and security documents and marked them as Exhibit A-1 to A-8.

I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced the loan of ₹20.00 Lacs and on 31.08.2023, a sum of ₹35,73,747.15p was due.

Accordingly, the application of the bank for the recovery of ₹35,73,747.15p (Rupees Thirty Five Lacs Seventy Three Thousand Seven Hundred Forty Seven and Paise Fifteen Only) with interest @12.50% per annum with yearly rests from 21.09.2023, till the date of payment is hereby allowed with costs. The liability of the legal heirs of Deceased Defendant would be limited up to the extent of the property(ies) inherited by them from the estate of Sh. Gurdeep Singh @ Gurdip Singh. Bank can recover its dues by the sale of mortgaged land fully detailed in para No.3A of the application.
