The Applicant Bank filed the present OA for the recovery a total sum of Rs.3,59,98,864.91ps towards Loan A/c. No. 130725010000001 from the defendants join y and severa y with future interest @11.65yo p.a. with monthly rests from the date of application till the date of realization along with costs and in default for sale of OA schedule property.

Summons served on D1 through paper publication, whereas summons served on D2 to 4. They were set ex-parte on 29.07.2026 as called absent and no representation.

Heard the Ld. Counsel for the Applicant Bank. perused the material placed on record.

The point that arises for consideration is:-

Whether the Applicant Bank is enti ed for the claim made in the OA against the Defendants and OA schedule property?

As stated supra, the Defendants remained ex-parte. The Evidence Affldavit coupled with the recitals in the documents viz., Exs. A.7 to A.27 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendants. ffio'tu

Hence, I hold that the Defendants^{are jointly} and severally liable to^pay the OA claim to the^{Applicant Bank} with future interest and costs.

In the result, the^{present Original ApplicationNo.77212026is} allowed as under:^-
