a) A sum of Rs.4,15,04,L45/- with interest @ 11.55olo p.a with monthly rests from 2L.04.2025 till the date of realisation;

b) A sum of RS.2,10,84,860/- with interest @ 14.90olo p.a with monthly rests from 2L.04.2025 till the date of realization and in default for sale of 10 hypothecated vehicles and mortgaged property as mentioned in the schedule ..A & B,,to OA.

2' As per the averments in the apprication, the Appricant Bank states that defendant no.1 is the public Llmited Company represented by its Directors defendants no.2 & 3 and defendants 2 & 4 stood as guarantors avaired Rs.4.95 crores for purchase of 10 Ashok Leyrand vehicles vide letter of arrangement dated 14.02.2023. The defendants executed agreement of roan cum hypothecation ancr guarantee agreement dated 16.03.2023. The defendants arso mortgaged the schedure mentioned property in favour of Appricant bank. After avairing the roan facirities, the defendants faired to compry the terms of sanction, hence the applicant bank classified the account as NPA on 08.01.2025 and recall notice was issued on 0g.04.2025. Inspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.

Smt Kalyani Rathod, Manager of the Applicant Bank examined herself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1to A.16.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant Bank is entitled for the claim made in the oA against the Defendants as prayed for?

Defendants remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and she exhibited relevant documents as Ex.A1 to A.16. In view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendants and hence the Applicant Bank is entitled to recover the claim made in the oA with future interest and costs.

B. In the result, the present OA is allowed with costs, as under:

The Defendants are jointly and severally liable to pay to the Applicant Bank a total sum of Rs.6,25,89,OO5/- (Rupees Six Crores Twenty

c) The Applicant bank is entiUed to proceed against the hypothecated vehicles and mortgaged property as mentioned in the schedule '.A &

B" to OA towards realization of the debt due;

d) The Applicant Bank is also entitled to proceed against the person and properties of defendants No.2 to 4 and properties of defendant no.1 firm towards realization of the debt due.

e) The Applicant Bank is entitled to the costs of the OA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.

s) Issue Recovery certificate accordingly.

h) Communicate a copy of the order to the pa rties concerned.
