On 14.09.2023, Punjab National Bank filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of Rs.26,47,865.82p with interest against Sh. Chand Singh and another (defendants).

Defendant No.1 is the borrower and defendant No.2 is the guarantor. Bank’s case is that on 08.04.2011, it had granted an OGC Limit of Rs.20 lacs to defendant No.1 for agricultural purpose. To secure the limit, defendant No.1 had hypothecated crops and mortgaged his agricultural land (fully detailed in para No.5.6 of the application). Defendant No.2 stood as Guarantor for the above facility vide Guarantee Deed dated 08.04.2011. The limit was chargeable to interest @13% per

annum with half-yearly rests. Defendants No.1/borrower confirmed the outstanding balance in the account vide balance confirmation cum revival letter dated 28.06.2013, 24.06.2016, 20.06.2019 and 25.05.2022. On 08.04.2023, a sum of Rs.26,47,865.82p was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application.

On 09.10.2023, summonses were sent to the defendants by registered post, which were duly served. However, defendants did not put in appearance. Vide order dated 28.10.2025, they were proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Mr. Ankit Kumar, Senior Manager, along with the loan and security documents.

I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced an OGC Limit of Rs.20 lacs and on 08.04.2023, a sum of Rs.26,47,865.82p was due. 6. Accordingly, the application of the bank for the recovery of Rs.26,47,865.82p (Rupees Twenty-Six Lacs Forty-Seven Thousand Eight Hundred Sixty-Five and Paise Eighty-Two Only) with interest @8.80% per annum with half-yearly rests from 14.09.2023, till the date of payment is hereby allowed with costs. The liability of all the defendants would be joint and several. Bank can recover its dues by the sale of hypothecated crops and mortgaged land (fully detailed in para No.5.6 of the application) as well as from the personal movable and immovable property(ies) of the defendants.
