The Applicant Bank filed the present oA against Defendants for recovery of a total sum of Rs.36,24,660.00 ps. (Rupees Thirty Six Lakhs Twenty Four Thousand Six Hundred and Sixty onry) with future interest @ g.15% p.a at monthry rests and penat interest @2ok p.a from 23.01.2026 tiil the date of realization and in default for sale of Mortgaged property as mentioned in the Schedule of property A to OA

in favor of the Applicant Bank. The Defendants created equitable Mortgaged morefully mentioned in Schedule A property to OA and Executed Memorandum of Deposit of rifle deeds for creation of Mortgage dated 16.12.2019 in favor of the Appticant Bank and deposited Original Sale Deed dated 2g.11.2019 in favor of the Applicant Bank. After avairing the roan facirity, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NpA and issued Legal Notice dated 29.11.2025 to the defendants. lnspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.

Sri. T. Narendra, Senior Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A..10.

Defendants cailed absent and set exparte. To substantiate the case of the Appricant Bank, AW.1, officiar of the Appricant Bank was examined and he exhibited rerevant documents as Ex.A.1 to A.10. ln view of the above, I hold that the Applicant Bank has estabrished their craim made in the oA against the Defendants and hence the Applicant Bank is entifled to recover the claim made in the OA with future interest and costs.

ln the result, the present OA is allowed with costs, as under:

The Defendants No. 1 and 2 are joinfly and severally liable to pay to the Appricant Bank a totar sum of Rs.36,24,660.00 ps. (Rupees Thirty Six Lakhs Twenty Four Thousand Six Hundred and Sixty Only) with future interest @ g.15% p.a from 23.01.2026 tilt the date of reatization.

The Applicant Bank is entifled to proceed against the Mortgaged Property as mentioned in the Schedule of the Property A to the OA towards realization of the debt due.

The Applicant Bank is also entitled to proceed against the and properties of Defendants No. 1 and 2 towards e debt due.

That Applicant Bank is entifled to the costs of the OA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.
