classification of loan accounts as NPA, applicant Bank served one recall notice dated 30'07 '202'l upon the defendants No.1 & 2 and informed them about the classification of their loan accounts as NPA and requested them to regularize the loan accounts, but the defendants did not compry the said notice; copy of said notice dated 30.07.2021 is annexed and marked as Annexure 'A-g'. Afte inspection of the schedured property, applicant bank came to know that the said propefi which is allofted to the defendant No.1 by the defendants No.3 & 4 is not registered in the name of defendant No.1 even after completion of construction work; that finding no other alternative, applicant bank sent one notice dated 30'07.202'l to the def,endants No.3 & 4 and requested t-hem to register the said property in the name of defendant No.1 and hand over the original tifle deed to the Bank; copyof receivedcopyof saidNoticedated go.oT.2o2lisannexedandmarkedas Annexure 'A-10', and valuation Report of the said subject property date<t 24.03.2023 is annexed and marked as Annexure 'A-11'. Since the defendants did not pay any attention to pay the applicant Bank's claim and also failed to deposit the original Title Deed to the applicant Bank, applicant Bank finding no other alternative sent one legal notice dated 24'05'2023 upon the defendants No.1 & 2 through its Advocate recalling them to pay the , entire amount due for a sum of Rs.42,32,909.40 inclusive of interest calculated upto 29'07.2021; copy of said Advocate Notice dated 24.05.2023 along with postal slips and delivery status reports are annexed and collectively marked as Annexure ,A-12,. Applicant Bank also served one letter upon defendants No.3 & 4 through its engaged Advocate, Ms. Samapti Roy dated 30.05.2023 and requested them not to transfer, dispose of, alienate, encumber and deal with the said property in any manner without prior permission in writing . of the Bank; copy of said letter dated 30.05.2023 along with postal slips and delivery status reports are annexed and collectively marked as Annexure 'A-13'. Certified copies of Statement of Accounts along with Certificate under Bankers' Books of Evidence Act, with interest calculation sheet, Annexure'A-14'& 'A-1s,, have been filed to show and prove the dues, and further interest to be calculated on and from 01.06.2023 @9.SOo/o per , annum along with penal interest @ 2o/o pet annum with monthly rest, till the date of realization of the entire dues, has been prayed. Applicant Bank submitted that their claim in the originalApplication is within limitation.
