On 06.08.2025, Punjab Gramin Bank filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of Rs.36,77,512/- with interest against Sh. Rajwinder Singh (since deceased), through his LRs. (defendants).

Bank’s case is that on 10.08.2011, it had granted a KCC limit of Rs.10 lacs, Term Loan of Rs.1.50 lacs, and Debt Swap of Rs.1 lac to the defendant for agricultural purpose. To secure the limit, defendant had mortgaged his agricultural land (fully detailed in para No.5.vii of the

application). The loan was chargeable to interest @13% per annum with half-yearly rests. The defendant had acknowledged his liability towards the debt on 18.07.2014, 06.03.2017, 28.12.2018, 29.12.2020, 01.08.2022 and 11.03.2025. On 31.07.2025, a sum of Rs.36,77,512/- was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application.

On 19.09.2025, summonses were sent to the defendants by registered post, which were duly served. However, defendants did not put in appearance. Vide order dated 11.03.2026, they were proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Mr. Gaurav Kumar, Assistant Manager, along with the loan and security documents.

I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced loan under various schemes and on 31.07.2025, a sum of Rs.36,77,512/- (KCC: Rs.31,96,879/-; Term Loan: Rs.3,00,658/- and Debt Swap: Rs.1,79,975/-) was due.

Accordingly, the application of the Bank for the recovery of Rs.36,77,512/- (Rupees Thirty-Six Lacs Seventy-Seven Thousand Five Hundred and Twelve Only) with interest @13% per annum with halfyearly rests from 06.08.2025, till the date of payment is hereby allowed with costs. The liability of both the legal heirs would be limited upto the extent of properties inherited by them from the estate of the deceased borrower for the whole of the decretal amount. Bank can recover its dues by the sale of mortgaged agricultural land (fully detailed in para No.5.vii of the application).
