The Applicant Bank^{filed the present OA for the recovery a total} sum of Rs. L,o},gg,657/-^{with future interest @7.35o/o p.a.} from the date of^{filling the application till the date of realization} along with costs, and^{in default, sale of oA mortgaged} property.

4, Heard ex-parte arguments from the Ld. Counsel of the Applicant Bank. perused the material placed on record.

The point that arises for consideration ist _

Whether the Appticant Bank is entitted for the claim made in the OA against the Defendant and OA mortgaged propefty?

As stated supra, the Defendant remained ex_pafte. The Evidence Affidavit coupred with the recitars in the documents viz., Exs.A.1 to A.1g marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendant. Hence, I hold that the Defendant is liable to pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Application No.1S1/2026 is allowed as under: -

i) The Sole Defendant is joinfly and severally liable to pay to the Applicant Bank a sum Rs. 1,08,99,657/- with future interest @7.35olo p.a. simple from the date of application till the date of realization;

ii) the OA claim is secured by way of mortgage of property, as described in the scneiu'ie annexed to the OA and applicant bank is entitled to proceed against the same for realisation of dues;

iii) the applicant bank is also entifled to proceed against the person and properties of defendant for realization of its dues;

iv) the applicant bank is entifled for the costs.
