The Applicant Bank filed the^present OA for the recovery of a total sum of Rs.22,16,958/- i.e., a sum of Rs.7,21,081/-^{towards Term} Loan A/c. No.170001057266 with lnterest @74.70o/o^p.a. and a sum of Rs.74,95,8771- towards Cash Credit Loan A/c. No.125000854891 with interest @12.85% p.a. from the defendants^jointly and severally frcm 29.12.2025 till the date of realisation along^with costs.

The Applicant Bank examined Anil D K, Legal Manager as AW-1 and marked 39 documents through him as Ex. A.1 to Ex. A.39.

Heard the Ld. Counsel for the Applicant Bank. Perused the^material placed on record.

The point that arises for consideration is:-

Whether the Applicant Bank is entitled for the claim made in the OA against^the Defendants?

As stated supra, the Defendants remained ex-parte. The^Evidence Affidavlt coupled with the recitals in the documents^{viz..Exs'A.1 to} A.39 marked on behalf of the Applicant^{Bank clinchesthe claim of} the Applicant Bank against the Defendants.^{Hence, I hold that the} Defendants are^jointly and severally^liable to^{pay the OA claimto} the Applicant Bank with future interest^{and costs.}

In the result, the^present Original Application^{No.150/2026is} allowed as under: -

i) The Defendants are^jointly and severally^{liable to payto} the Appllcant Bank a total sum of^{Rs.22,16,958/-i.e', a} sum of Rs.7,21,081/- towards Term^Loan A/c. No.170001057266 and a sum of^{Rs.L4,95,877/'} towards Cash Credit Loan^{A/c.No.125000854891; with} future interest @5.9olo F.a. simple,^{from the date of} application till the date^{of realization;}
