ORDER

The Applicant Bank filed the present OA against Defendants for recovery of a total sum of Rs.58,72,249.21 Ps. (Rupees Fifty Eight Lakhs Seventy Two Thousand Two Hundred Forty Nine and Paise Twenty One Only) i.e a sum of -

(i) Rs.49,75,022.15 Ps. under Home loan Account with interest @7.50o/o^{p.a plus penal interest} @2o/o^{p.a wilh monthly rests} from the date of filing of this OA till the date of reallzation;

(ii) Rs.8,97,227.06 Ps. under Term loan Account with interest @10.10%^{p.a plus penal interesl} @2oh^{p.a with monthlyrests} from the date of flling of this OA till the date of realization.

and in default for sale of Hypothecated Movables and Mortgage Property as mentioned in the Schedule of Property A and B to oA.

As per the averments in the application, the Applicant Bank states that Defendant availed Home Loan facility under Star Home facility of Rs.48,17,0001- repayable in 360 equated monthly of Rs.38,2401 p.m together with interest @8.85% monthly rests and executed Home Loan Agreement .2023 in favor of the Applicant Bank. The Defendant Mortgage morefully mentioned in Schedule of 3

Property A to OA and executed Memorandum of Deposit of Title Deeds dated 03.10.2023 and the Defendant deposited Original title Deed in favor of the Applicant Bank. The Defendant availed Term Loan facility of Rs.9,80,000/- repayable in 84 equated monthly installments of Rs.'16,961/- p.m together with interest @11^{.35o/o p.a with monthlyrests and executed Loan cum} Hypothecation Agreement dated 31 .05.2024 in favor of the Applicant Bank. After availing the loan facility, the defendant failed to comply the terms of sanction, hence the applicant bank classified the accountas NPA on14.07.2025 and issued Demand Notice dated 04.08.2025 under Section 13(2) of the SARFAESI Act, 2002 to the defendant. lnspite of several requests and demands, the defendant did not clear the outstanding. Hence this OA.

Defendant called absent and set exparte on 22.04.2026.

Sri. Ruttala Sarath Kumar, Officer (Manager) of the Applicant Bank examined himself as AW 1 and exhibited relevant documents, which are marked as Ex.A.1 to A.36.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant is entitled for the claim made in the OA against the nt as prayed for?

Defendant remained exparte. To substantiate the case of the Applicant Bank, AW.'1 , official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A.1 to 4.36. ln view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendant and hence the Applicant Bank is entitled to recover the claim made in the OA with future interest and costs.

ln the result, the present OA is allowed with costs, as under :

The Defendant is liable to pay to the Applicant Bank a total sum of Rs.58,72,249.21 Ps. (Rupees Fifty Eight Lakhs Seventy Two Thousand Two Hundred Forty Nine and Paise Twenty One Only) i.e a sum of -

(i) Rs.49,75,022.15 Ps. under Home loan Account with interest @7.50o/o p.a from the date of filing of this OA till the date of realization;

(ii) Rs.8,97,227.06 Ps. under Term loan Account with interest @10.10% p a from the date of filing of this OA till the date of realization.

Bank is entitled to proceed against the Movables and Mortgaged Properties as n the Schedule of Property A and B to the OA ion of the debt due.

The Applicant Bank is also entitled to proceed against the person and properties of Defendant towards realization of the debt due.

11 That Applicant Bank is entitled to the costs of the OA.

Communicate a copy of the order to the parties concerned.
