HDFC Bank Limited has filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of ₹20,39,861/- with interest against Smt. Lakhwinder Kaur and others (defendants).

Bank’s case is that on 18.09.2019, it had granted C.C. Limit of ₹13.85 Lacs and F.D.L. Limit of ₹3.85 Lacs both aggregating to ₹17.70 Lacs to defendant Nos.1 and 2 for agricultural purpose. To secure both the loan facilities, Defendant No.2 had mortgaged his land (fully detailed in para No.3A of the application). Defendant Nos.3 and 4 stood as

guarantors for both the loan facilities vide Guarantee Agreements dated 19.09.2019. Both the loan facilities were chargeable to different rates of interest. On 01.04.2023, a sum of ₹20,39,861/- was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application.

On 28.08.2023, summonses were sent to the defendants by registered post, which were duly served. However, defendants did not put in appearance. Vide order dated 06.09.2024, they were proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Mrs. Pooja Arora, Manager along with the loan and security documents and marked them as Exhibit A-1 to A-15.

I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced the total loan of ₹17.70 Lacs (C.C. Limit of ₹13.85 Lacs and FDL Limit of ₹3.85 Lacs) and on 01.04.2023, a sum of ₹20,39,861/- was due.

Accordingly, the application of the bank for the recovery of ₹20,39,861/- (Rupees Twenty Lacs Thirty Nine Thousand Eight Hundred Sixty One Only) with interest @11% p.a. with half-yearly rests from 29.07.2023, till the date of payment is hereby allowed with costs. The liability of all the defendants would be joint and several. Bank can recover its dues by the sale of mortgaged land fully detailed in para No.3A of the application as well as from the personal movable and immovable property(ies) of the defendants.

Recovery Certificate be issued accordingly.
