On 17.06.2024, Punjab Gramin Bank filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of Rs.57,78,198.50p with interest against Sh. Veer Singh (defendant).

Bank’s case is that on 28.12.2013, it had granted a KCC limit of Rs.29.25 lacs to the defendant for agricultural purpose. To secure the limit, defendant had hypothecated assets and mortgaged his agricultural land (fully detailed in Exhibit A-4 and para No.5.vii of the application, respectively). The loan was chargeable to interest @11.50% per annum with half-yearly rests. The defendant had acknowledged his liability towards the debt on 13.09.2016, 18.03.2019, 04.05.2021 and 18.08.2023. On 24.12.2022, Bank had sent recall notice to the defendant. On 11.06.2024, a sum of Rs.57,78,198.50p was due from the defendant. Despite repeated requests, defendant did not make the repayment. Hence, this application.

On 29.08.2024, summons was sent to the defendant by registered post, which was duly served. However, defendant did not put in appearance. Vide order dated 17.07.2025, he was proceeded ex parte . 4. In order to prove its case, the Bank has placed on record the affidavit of Mr. Pawandeep Salhotra, Branch Manager, along with the loan and security documents. 5. I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced a KCC limit of Rs.29.25 lacs and on 11.06.2024, a sum of Rs.57,78,198.50p was due. 6. Accordingly, the application of the Bank for the recovery of Rs.57,78,198.50p (Rupees Fifty-Seven Lacs Seventy-Eight Thousand One Hundred Ninety-Eight and Paise Fifty Only) with interest @11.50% per annum with half-yearly rests from 17.06.2024, till the date of payment is hereby allowed with costs. Bank can recover its dues by the sale of hypothecated assets and mortgaged land (fully detailed in Exhibit A-4 and para No.5.vii of the application, respectively) as well as from the personal movable and immovable property(ies) of the defendant.

Pending IAs, if any, stand disposed of. 8. Recovery Certificate be issued accordingly. 9. Parties are directed to appear before Recovery Officer on 09.10.2026 . 10. A Copy of this order along with Recovery Certificate be sent to the Recovery Officer as well as the parties.
