As per the averments in the application, the Applicant Bank states that Defendant No. 1 is a proprietorship Firm represented by its Proprietor Defendant No. 2 availed Term Loan facility of Rs.98,31,000/- with interest @11.1% p.a with monthty rests repayable in EMI's of Rs.1,59,210/- and working capitalfacility of Rs.15.00 Lakhs together with interest @11.10o/o p.a with monthly rests and executed Composite Hypothecation Agreement dated 12.09.20219 in favor of the Applicant Bank. The defendants availed GECL facility of Rs.4.00 Lakhs with interest @7.50% p.a with monthly rests repayable in 36 monthly installments andexecutedcommon Hypothecation Agreement dated 09.07.2020 in favor of the Appticant Bank. The Defendants availed Term Loan facility of Rs.2.00 Lakhs and executed Agreement Deed of cum Hypothecation dated 09.07.2021 dated 09.07.2020 in favor of the Appticant Bank The defendants availed GECL 1.0 extension loan facility of Rs.24.00 Lakhs with interest @7.50% p.a with monthly rests repayable in 48 monthly installments and executed Supplemental Common Hypothecation Agreement dated 06.11.2021 in favor of the Applicant Bank.
