The Applicant Bank filed the present OA for the recovery a total sum of Rs.1,13,77,3541- i.e., a sum of Rs.80,61,791l- towards Term Loan I A/c. No.75790600000473 with interest @11% p.a., a sum of Rs.30,53,394/- towards Term Loan II A/c. No.75790600000475 with interest @11olo p.a., a sum of Rs.24,960/- towards Fund Interest Term Loan A/c. No.75790600001169 with interest @9.05yo p.a. and a sum of Rs.2,37,209/- towards Working Capital Loan A/c. No.75790600001170 with interest @10olo p.a. from the defendants^jointly and severally inclusive penal interest @2olo p.a. from the date of application tlll the date of realization along with costs and in default for sale of OA schedule properties.

Summons served on D1 to 4 through paper publication. They were set ex-parte on 18.06.2026 as called absent and no representation.

The Applicant Bank examined G Praveen Kumar, Chief Manager, as AW-1 and marked 31 documents through him as Ex. A.1 to Ex. A.31.

The point that arises for consideration is:-

As stated supra, the Defendants remained ex-parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs. A.1 to A.31 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendants. Hence, I hold that the Defendants are^jointly and severally liable to pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Application No.1067/2025 is allowed as under: -

i) The Defendants are jointly and severally liable to pay to the Applicant Bank a total sum of Rs.1,13,77,354/- i.e., a sum of Rs.80,61,791l- towards Term Loan I A/c. No.75790600000473, a sum of Rs.30,53,394/- towards Term Loan II A/c. No.75790600000475, a sum of Rs.24,960/- towards Fund Interest Term Loan A/c. No.75790600001169 and a sum of Rs.2,37,209/- towards Working Capital Loan A/c. No.75790600001170; with future interest @11.25olo^p.a. simple from the date^of application till the date of realization;

ii) the OA claim is secured by way of mortgage of properties described in the schedule annexed to the OA and the applicant bank is entitled to proceed against the same to realise its debt; %6rt

iii) the applicant bank is also entltled to proceed against the person and properties of defendants for realization of lts dues;

iv) the applicant bank is entitled for the costs.
