The Applicant Bank filed the^present OA^{againstDefendants} for recovery of a total sum of Rs. 58,53,662.68 Ps.^(Rupees Fifty Eighty Lakhs Fifty Three Thousand Six Hundred and Sixty Two and Sixty Eight Paise Only) together^{with future} rate of interest @10.65Yo^p.a with monthly rests from 01.12.2025 till the date of realization and in default for sale of Hypothecated Movables and Mortgaged Property as mentioned in the Schedule of Property A to F to OA.

As per the averments in the application, the Applicant^Bank states that Defendants availed credit facility of Rs.'1,20,00,000/- with interest @9.55Yo^p.a with compounded monthly and executed necessary loan documents such as Sanction Memorandum dated 18.10.2021;^Common Hypothecation Agreement dated 20.11.2021 in favor of^the Applicant Bank. The Defendants No. 2 and 3^{stood as a} personal Guarantor and executed Guarantee Agreement dated 20.11.2021 in favor of the Applicant^Bank.The Defendant No. 3 created equitable mortgaged^morefully Schedule of Property to OA and executed Deposit of Title Deeds dated 17.11.2021 in icant bank. defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NPA on 05.05.2025 and issued Recall/Demand Notice dated 13.05.2025 and possession notice dated 21.08.2025 under the SARFAESI Act, 2002 to the defendants. lnspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.

Defendants called absent and set exparte on 29.06.2026.

Sri. Mohan G A Kini, Chief Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.8.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant bank is entitled for the claim made in the OA against the Defendants as prayed for?

Defendants remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A.1 to .view^{of the above, I hold that the Applicant Bank has} r claim made in the OA against the Defendants ,r,(,+i"%ffit Applicant Bank is entitled to recover the claim /i;- ,S n"n3i$ with future interest and costs. iJ^{z eTfre?dhth"e} i i1^.( r'1 ^S,r.

ln the result, the present OA is allowed with costs, as under :

The Defendants No. 1 to 3 are jointly and severally liable to pay to the Applicant Bank a total sum of Rs. 58,53,652.68 Ps. (Rupees Fifty Eighty Lakhs Fifty Three Thousand Six Hundred and Sixty Two and Sixty Eight Paise Onty) together with future rate of interest @10.65% p.a from 01.12.2025 till the date of realization.

The Applicant Bank is entifled to proceed against the Hypothecated Movables and Mortgaged properties AS mentioned in the Schedule of the^property A to F to the OA towards realization of the debt due.

The Applicant Bank is also entitled to proceed against the person and properties of Defendants No. 2 and 3 and properties of Defendant No. 1 firm towards realization of the debt due.

That Applicant Bank is entitled to the costs of the OA.
