HDFC Bank Limited has filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the

recovery of ₹28,24,960.75p with interest against Sh. Harbhinder Singh and others (defendants).

Bank’s case is that on 10.09.2018, it had granted K.C.C. Limit of ₹18.35Lacs and another C.C. Limit of ₹3.10Lacs and Term Loan of ₹1.00 Lacs under K.G.C. Scheme aggregating to ₹22.45 Lacs to defendant No.1 (since deceased now survived by his legal heirs) and defendant no.2 in the form of K.C.C Limit for agricultural purpose. To secure all the loan facilities, Defendant No.1 had mortgaged his land (fully detailed in para No.3A of the application). Defendant Nos.3 and 4 stood as guarantors for all the facilities. All the loan facilities were chargeable to interest @10% per annum with half-yearly rests. On 20.02.2023, a sum of ₹28,24,960.75p was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application.

On 15.06.2023, summonses were sent to the defendants by registered post, which were duly served. 3A During the course of the proceedings, Bank filed IA No. 701/2024, for impleading the legal heirs of defendant No.1 which was allowed vide order dated 15.01.2025. Thereafter, summonses were sent to the LRs’ of defendant No.1 which were duly served. However, none from the defendants/LRs’ put in appearance. Vide order dated 28.07.2025, all the defendants were proceeded ex parte . 4. In order to prove its case, the Bank has placed on record the affidavit of Sh. Harminder Pal Singh, Remedial Manager along with the loan and security documents and marked them as Exhibit A-1 to A-19.

I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced the total loan of ₹22.45 Lacs and on 20.02.2023, a sum of ₹28,24,960.75p was due.

Accordingly, the application of the bank for the recovery of ₹28,24,960.75p (Rupees Twenty Eight Lacs Twenty Four Thousand Nine Hundred Sixty and Paise Seventy Five Only) with interest @10% per annum with half-yearly rests from 16.05.2023, till the date of payment is hereby allowed with costs. The liability of the legal heirs of defendant No.1 would be limited to clear the outstanding amount upto the extent of the property(ies) inherited by them from Sh. Harbhinder Singh (now deceased), whereas the liability of defendant Nos.2 to 4 would be joint and several. Bank can recover its dues by the sale of mortgaged land fully detailed in para No.3A of the application as well as from the personal/inherited movable and immovable property(ies) of the defendants accordingly.

Pending IAs, if any, stand disposed of. 8. Recovery Certificate be issued accordingly. 9. Parties are directed to appear before Recovery Officer on 29.09.2026. 10.
