This is Misc. application filed by the applicant for reviewing the order dated 08.12.2025. In fact earlier, the respondent bank had very honestly came and admitted that borrowers has deposited forged the documents with them, therefore, they are handing over the possession back and the same were permitted. There was an averment made in the Securitization Application seeking compensation. Be that it may be, since without contesting the matter, the respondent has honestly admitted, there was no question of granting any compensation. It is not the case that there was any error apparent on the fact of the record.
It is the discretion of the Tribunal in facts and circumstances as per the record to grant compensation or not. Instead of contesting to keep the possession though the respondent bank has very honestly admitted that they have returned the possession, therefore, there is no question of grant of compensation.
In view of the above, this Misc. Application stands disposed of. File be consigned to record, as per rules. Copy of order be uploaded on website.
